The construction sector faces new challenges due to tax and legal changes, experts warn

Experts suggest strengthening cost control, compliance, and legal security for businesses

SANTO DOMINGO.– Tax changes and the new legal landscape facing the construction sector are forcing companies to strengthen their organization, control their costs, and adopt greater mechanisms for prevention and legal security.

The warning was raised during the Constructive Luncheon of the Association of Builders of Santo Domingo East (ACOSDE), where specialists analyzed the main challenges currently facing the industry.

The president of ACOSDE, Riubell Montes de Oca, called on the business community to thoroughly understand, through legal advisors and the institution itself, all the new aspects of the penal code so that they can prepare their companies with compliance programs to face the great challenges this entails.

Engels Fortuna, referring to the impact of Law 30-26 on construction, explained that the new legislation modifies the structure of direct and indirect costs of construction companies, in addition to higher withholdings on technical services, bank transfer costs, temporary changes in Income Tax for larger companies and new provisions on solid waste.

Fortuna argued that this scenario forces the sector to develop short, medium and long term strategies to make it more resilient, reduce its dependence on monetary policy and improve the control of its costs and benefits.

Trust sustains the business

Meanwhile, Tania de León, during her presentation on Criminal Compliance Programs in the Construction Sector: Context, Risks and Culture, highlighted that "trust is what sustains the construction business," so companies must strengthen their structures to identify, prevent and demonstrate adequate risk management.

He highlighted compliance as a fundamental tool to transform business management into prevention, control and evidence, especially in light of the new criminal liability regime.

For her part, Reyna Echenique, analyzing the new legal scenario of the real estate sector, stated that a project is no longer built solely with concrete, but also with processes, clear contracts, information and legal security.

Echenique introduced the concept of "Legal Added Value," arguing that proper legal management can become an element that adds value and reduces risks. The specialist maintained that the developer of the future must focus on legally sound, commercially transparent, and well-organized projects because, as she stated, "building well will continue to be essential, but it will no longer be enough.".

The conference “From Budget to Actual Profit: Cost Control per Project and Tax Compliance 2026 for Construction Companies” was also given by executives from ADM Cloud, who addressed tools and strategies to improve cost control per project and strengthen tax compliance for construction companies.
