The bill on real estate rentals and evictions, which expired last year in the Chamber of Deputies, among the benefits it brings, clearly specifies in its article 11 paragraph two who is responsible for paying the real estate brokerage fees.
It clearly shows that it is very easy to identify who the contractor was, since the publications and offers demonstrate that he has been hired by the owner.
As an expert in procedures, I am thrilled to know that this new project brings agility to the eviction procedure in case of contract termination due to non-payment, since this is one of the most worrying procedures in the sector and one that keeps many owners up at night.
Something very important that I haven't seen emphasized is that this project clearly specifies that rental prices will not be offered in dollars or any other currency than pesos, the local currency.
The purpose of this legislative piece is to regulate the legal conditions under which the rental contract originates in the Dominican Republic.
Within the guarantees of the payment of the rent, the owners may require the deposit or construction of a surety as long as it is a property that is located in the urban or suburban area.
It also specifies that conflicts arising from the return of the rental deposit will be resolved by the justices of the peace in the first instance in the jurisdiction in which the property corresponds.
In the case of the obligations of the owners, they are obliged to demonstrate and guarantee the legitimacy of their right, use and enjoyment of the property.
