SANTO DOMINGO – The Ministry of Labor's decision to halt a construction project is not arbitrary or an isolated punitive measure. It is a legal power that is activated when conditions exist that endanger the lives and safety of workers.
This is the view of labor lawyer Darnetty Lugo, who points out that these interventions are, in most cases, due to basic safety violations, such as the absence of protective equipment, unsafe work environments, or the lack of organizational structures aimed at risk prevention.
The law is not optional
Regulation 522-06 on Occupational Safety and Health establishes the standards that all companies, including those in the construction sector, must comply with to guarantee safe working conditions. It is not a reference guide, but a legal obligation whose non-compliance can have immediate consequences.
In this context, the Ministry of Labor has the authority to order the suspension of work when it detects irregularities. This measure aims to prevent accidents and correct problems before they cause more serious damage, it explains.
According to the specialist, when this point is reached, it is understood that there is a responsibility attributable to the employer, for not having guaranteed a safe environment for its workers.
What triggers a shutdown?
In practice, the causes are often more common than people think. A lack of personal protective equipment, unsafe working conditions, or the absence of a safety committee are some of the factors that can trigger an intervention.
Added to this is the non-compliance with essential administrative processes, such as the registration of workers in the Social Security Treasury (TSS), or the documentation required in labor matters.
For Lugo, these elements are not minor details, but essential components of a prevention system that is often underestimated in the daily dynamics of construction.
A common mistake in the sector
One of the main mistakes, as observed in practice, is assuming that safety rests solely with the contractor. However, the legal framework establishes a broader responsibility.
Although the contractor directly carries out the work and must guarantee protocols, equipment and internal organization, the developer also has the duty to supervise that everything is being done correctly, the expert argues.
He adds that this includes verifying staff registration, compliance with labor requirements, and the existence of prevention mechanisms within the project.
What weighs more than the contract
In this scenario, the legal interpretation goes beyond what is established in the agreements between the parties.
The Supreme Court has been clear in establishing that what is stipulated in a contract is not enough. The determining factor is who exercises real control over the work and the conditions under which it is carried out.
According to Lugo, this criterion reinforces the idea that responsibility cannot be transferred absolutely through documents, but is defined based on practice and effective project management.
Consequences that go beyond paralysis
Failure to comply with safety regulations can not only lead to the suspension of a project, but also constitutes a workplace offense that may result in financial penalties.
Darnetty Lugo cites article 720 of the Labor Code, which contemplates fines for companies that violate provisions related to the safety and health of workers, making these omissions a legal and financial risk.
Beyond the sanctions, the work stoppage serves as a warning within the sector. It is not a punishment, but a preventative measure that compels the correction of structural flaws in workplace safety management.
