ONEC warns that recurring changes to the Solid Waste Law create legal uncertainty

The trade association believes that successive changes to legislation affect business planning and regulatory predictability

SANTO DOMINGO – The National Organization of Commercial Enterprises (ONEC) expressed its concern about the new modifications approved by the Senate to the draft reform of Law 225-20 on Comprehensive Management and Co-processing of Solid Waste, considering that the repeated changes to the regulations generate a scenario of uncertainty for the productive sectors.

The entity pointed out that the contribution regime established in article 36 has been modified again a few months after the entry into force of Law 98-25, a situation which, in its opinion, hinders the financial planning and regulatory compliance of companies.

They question successive changes to the legislation

According to ONEC, beyond the modifications made to the contribution scales, they express concern that legislation with a direct economic impact is subject to frequent changes and approved through accelerated procedures.

"Trade needs clear, stable, and predictable rules. Financial planning, investments, and regulatory compliance cannot depend on successive changes approved in a matter of days," the organization said in a statement.

The entity recalled that the reform was approved in the Senate a few days before the expiration of the first semi-annual payment of the special contribution, set for June 30, while subsequently the Chamber of Deputies introduced new modifications related to the contribution scales, a transitional regime for the fiscal year 2025 and the exceptional extension of the payment deadlines for some companies.

They are calling for more technical discussion

The organization reiterated its support for initiatives aimed at strengthening the comprehensive management of solid waste and acknowledged the need to establish financing mechanisms to address the country's environmental challenges.

However, he argued that legislative reforms with a high economic impact must be based on technical analysis, broad consultation processes, and mechanisms that guarantee legal certainty for both the State and taxpayers.
