The construction company maintains that the decision of the Superior Administrative Court is not final and affirms that the project is 90% complete
SANTO DOMINGO. – Grupo Choroni and Constructora Armando Toros, the companies responsible for the Everest Tower project in the Piantini sector, issued a statement assuring that the work continues, despite the ruling by the Superior Administrative Court (TSA) that annulled the urban planning permits for the complex.
The document, released on July 30 through the construction company's Instagram account, is addressed to owners, clients, brokers and partners of the project and in it the company clarifies that the judicial decision, issued on July 9 and known this week, is not final and is subject to review before the corresponding authorities.
According to the text, the project was developed on the basis of permits and authorizations that, according to the company, were evaluated, approved and renewed by the competent bodies for three consecutive years.
The construction company indicated that the project is currently approximately 90% complete, backed by a significant investment, a specialized technical team, and years of planning and execution.
The company stated that it is confident in the strength of the legal and technical foundations that support its position, and that it will continue to take, in accordance with the law, the necessary actions to protect the project and the interests of owners, clients, and partners.
He also assured that his commitment remains firm and that he will continue to act with responsibility, transparency and respect for institutions, promptly communicating any relevant information through his official channels.
The statement concludes with a phrase that serves as an institutional closing: "Everest continues to advance.".
The publication comes a few days after the release of ruling no. 0030-1642-2026-SSEN-00280, issued by the Fourth Chamber of the TSA on July 9, which annulled the Certificate of No Objection to Preliminary Project no. ADN-DPU-2020-0466 (Resealed), the Certificate of Land Use and Building Setback and of No Objection to Preliminary Project no. ADN-DPU-2021-1202, and the Certificate of Land Use and Building Setback and of No Objection to Preliminary Project no. DPU-CC-2023-0040, all issued in favor of Grupo Choroni, SRL.
The origin of the dispute
The ruling, which upheld an appeal filed by the National District City Council (ADN), determined that successive renewals of permits allowed a substantial transformation of the project: the original proposal contemplated a building of 64 apartments, while subsequent modifications authorized a commercial and service complex of 238 condominium-hotel suites, with restaurants, offices, event halls and a heliport.
According to the court, that change raised the density of the project to about 3,763 inhabitants per hectare, well above the limit allowed for the area, and took the building to 22 levels above ground, plus a mezzanine and a helipad on the roof, a height that exceeds the maximum authorized for the tertiary road type A where the property is located.
The ruling also noted that some side and rear setbacks fell below the minimum of four meters required for buildings of that size.
The legal process originated from the formal opposition that the Piantini neighborhood association presented to the City Council in 2023, arguing that the project, due to its scale and diversity of commercial uses, would affect mobility, safety and quality of life in an area with a mostly residential vocation.
The statement does not make it clear whether the company has filed a formal appeal with a higher authority.
