José Rosado, the architect's father, believes that the 12 months of preventive detention as a coercive measure against Corporal Jandi Disla and Rafael Castillo Nova will allow for an investigation to clarify the circumstances surrounding his daughter's murder.
Voluntary homicide, criminal association and complicity in committing murder, is the legal classification that the Public Ministry has provisionally assigned to the events that occurred last Saturday, the second of this month, in which the architect Leslie Rosado, daughter of the architect José Rosado, of Constructora Armando Toros, was killed.
These acts are foreseen and sanctioned in the normative content of articles 59, 60, 265, 266, 296, 297, 298 and 302 of the Dominican Penal Code, principle VI of absolute priority, articles 3, 12 and 396 of Law 136-03, on the Code for the Protection and Fundamental Rights of Children and Adolescents.
At the time of the incident, Leslie and her 15-year-old daughter were returning from her father's birthday celebration. They were traveling along Duarte de Andrés Avenue towards Boca Chica in a Mercedes Benz, heading west to east, approximately 500 meters from the small park in Andrés.
According to the Public Prosecutor's Office, Leslie Rosado slightly grazed the Suzuki motorcycle driven by Disla Batista, and the corporal was accompanied by his wife, Santa de Jesús Ramírez, and his two minor children, who were uninjured, according to medical diagnoses.
Once the alleged accident occurred, the Prosecutor's Office states, the accused Disla Batista fired several shots that forced Leslie Rosado to not stop the vehicle, trying to save her life and that of her daughter.
Later, according to the case file, Corporal Disla Batista got on the motorcycle driven by co-defendant Rafael Castillo Nova, and together they pursued the architect's vehicle. Upon reaching the vicinity of Boca Chica beach, Jandi Disla fired several more shots, one of which struck the vehicle near the license plate and another lodged in the right rear tire.
The file says that trying to escape, the architect made a left turn to return to the Yacht Club, the place from which she had left minutes before; however, traffic did not allow her to advance, a moment that was taken advantage of by the accused Janli Disla to approach.
With his service weapon in hand, the officer repeatedly struck the driver's side window, injuring the victim's left hand, and fired two shots, one of which struck her in the head, causing her death. The report indicates that during the pursuit, the accused requested assistance from members of the Dominican Navy who were traveling in the area in one of their trucks.

Yesterday, before Judge Leomar Quezada of the Permanent Attention Office of Santo Domingo East, who imposed a one-year preventive detention to be served in San Pedro de Macorís, the National Police corporal, Jandi Disla Batista, admitted that he killed the architect Leslie Rosado, according to his lawyers.
However, lawyer Luis López clarified that the admission did not occur in the terms presented by the Public Prosecutor's Office, which argued that the incident was a murder. He explained that his client admitted his guilt for the act, which was triggered by a moment of "rage upon seeing his wife and children on the ground.".
He said his client is remorseful for what happened and that, although they did not oppose pretrial detention, they did not want him sent to La Victoria prison as the Public Prosecutor's Office requested. They argue that the corporal's life could be in danger in that prison.
Luis López announced that he will appeal the decision to the Court, arguing that the one-year prison sentence imposed on the police corporal is excessive. He believes that with the evidence the Prosecutor's Office has, they could complete their investigation in three months.
“We understand that the incident did occur, but not as the Public Prosecutor's Office has stated… We are going to appeal the decision, because we believe that the incident can be investigated within three months. It was a moment of rage; hatred blinded him when he saw his wife on the floor… It is an act he regrets, which is why it is considered manslaughter, not murder or criminal conspiracy,” the police officer's lawyer stated.

He said that this crime was carried out with great aggression, anger and under "strange actions" so he hopes "the culprit or culprits" of the murder will appear.
“That time will be enough for them to conduct thorough and comprehensive investigations so that this matter is clarified in an exemplary manner and the culprit or culprits are truly identified and clearly verified,” Rosado stated after leaving the hearing where Judge Leomar Quezada of the Permanent Attention Office of Santo Domingo East imposed the measure against the main suspect in the murder of his daughter.
Motorcyclist will also appeal
The lawyers for motorcyclist Rafael Castillo Nova, who was also sentenced to one year of preventive detention, also announced that they will go to the Court of Appeals, after considering that their client had nothing to do with it, that he transported the police corporal, but that he does not even know him.
“The corporal completely exonerated our client. He said they didn't know each other, that he approached the other person immediately after the other hit him and fled, and that further down the road the person got off the motorcycle and continued on foot to where he committed the crime. We will appeal this decision because we believe our client's prison sentence is unjustified,” said attorney Aneury Mercedes.
