It is expected to be approved in 2026, as it is a project long awaited by the Dominican real estate sector.
SANTO DOMINGO.- TheReal Estate Intermediation Law remains one of the pending challenges for the real estate sector in the Dominican Republic, a regulation that in 2026 is still awaiting approval in the National Congress despite its importance in regulating the profession.
The last meeting was held in July 2025 by the president of the Association of Real Estate Agents and Companies (AEI), Alberto Bogaert, and the senators Omar Fernández, Rafael Duluc (Cholitín), Alexis Victoria Yeb, Aneudy Ortiz and Ramón Rogelio Genao; representing Acoprovi, Jaime González.
The purpose of that meeting was to continue strengthening alliances in preparation for the approval of the bill currently before the National Congress, which would establish the rules for real estate transactions in the Dominican Republic.
Alberto Bogaert, president of the AEI, declared in June to El Inmobiliario that one of the relevant points of the meeting was to achieve a consensus that the MIVHED, and not the Ministry of Industry and Commerce, should be the entity in charge of assuming the leadership of the real estate issue in the Dominican Republic.
“It has been decided that the Ministry of Housing will be the institution in charge of the real estate sector. It remains for them to meet and take the next steps internally,” Bogaert stated.
Although several initiatives to regulate real estate intermediation have been processed through Congress in recent years, the country still lacks a legal instrument to regulate the practice of real estate.
The last initiative still under consideration in the Legislative Branch was submitted by representatives on February 18: a bill that would regulate the real estate industry in the country and which was to be presented during that legislative session. It was expected that the bill would be reintroduced once the first legislative session began, which would last 150 days, from February 27 to July 26, 2025.
Although it is a project that was expected to be in its final stage, El Inmobiliario consulted the president of the Association of Real Estate Agents (AEI) to find out the latest steps that have been taken to finalize such a long-awaited and needed real estate intermediation law.
The president of the association reported that the bill has been drafted and reviewed. “It has the approval of the Senate committee that studied it, and it has also been agreed upon with the various public and private sectors. It is currently in the Senate awaiting its submission, that is, its formal presentation,” he stated.
He also added that he hopes it will be approved this year. “Yes, of course, everything is already done. We are just waiting for the senator who is handling it, Rafael Duluc (Cholitín), the senator from Higüey, to present it to the legislature when it opens in February.”.
Bogaert also announced that all the necessary procedures on the part of the union had been completed and that they were simply waiting for the Legislative Branch to approve them. "From our perspective, everything is done; all the processes have been exhausted.".
“The thing is, before, for one reason or another, the necessary consensus wasn't reached, no… the conditions weren't right, but now all the conditions are 100% unified and it's just a matter of waiting for the legislator to finalize it,” the union leader explained.
The project
The bill includes the regulatory, organizational and management regime of the real estate brokerage activity, applicable to real estate intermediaries operating in the national territory, the requirements for its exercise, the rights and obligations of brokers and agents, as well as the brokerage contract, in addition to the quality control of such services.
If approved, it will apply throughout the national territory to natural or legal persons who act as brokers or real estate agents, "regardless of the name they use, as defined by this law and with the guarantees provided for in it and its regulations.".
