Remember the obligation to inform about the means used for payment of real estate.
SANTO DOMINGO.- The General Directorate of Internal Taxes (DGII) yesterday reminded taxpayers and the general public of the obligation that in the notarial process of transferring or purchasing a property, which exceeds one million pesos, the means used to pay must be explained.
In a notice dated yesterday, February 24, 2025, the tax collection agency warns that failure to comply with this measure will result in the agency not issuing payment authorizations for transfers or discharges.
“This Directorate General, when the taxpayer makes the payment of the real estate transfer tax, will verify if it complies with the provisions of the aforementioned regulation, and if not, no authorizations for payment of transfer or discharge for said acts will be issued,” the document states.
The DGII maintains that the notice is made in accordance with the provisions of General Rule 07-22, which regulates the application of the requirement for reliable proof of payment by public notaries, the acts executed by the notary, as well as those under private signature.
It adds that the above applies to cases in which the right of ownership of a property is transferred or established for an amount exceeding one million Dominican pesos, which must contain information on the means used to make the payment(s).
“The above will apply to acts of purchase and sale, payment in kind, exchange, contingency fee and amicable partitions related to the transfer of real estate,” the publication states.
It states that, for these procedures, the conclusive proof of payment should not be provided, without prejudice to the obligation of the notary to demand and preserve it as indicated by General Rule 07-22.
