Punta Cana, Samaná and La Vega: the trail of seizures in tourist areas

The ruling No. 249-02-2026-SSEN-00040 identifies at least 22 properties in tourist destinations in the country, Las Terrenas, Arroyo Barril, Verón, Jarabacoa and La Romana, included in the confiscation order of the Thirty-Second paragraph of the ruling

SANTO DOMINGO. – The seizure of more than 400 assets ordered in the sentence of the First Collegiate Court of the Criminal Chamber of the Court of First Instance of the National District, which condemned 20 people accused of prevarication, embezzlement, fraud against the State, illicit enrichment and aggravated money laundering, includes 22 properties located in Las Terrenas, Arroyo Barril, Verón, Jarabacoa and Cumayasa.

The ruling in the case, which the Public Prosecutor's Office codenamed "Coral," identifies properties in four areas of high tourist real estate activity: Samaná, Las Terrenas and Arroyo Barril; La Altagracia, Verón and Punta Cana; La Vega and Jarabacoa; and La Romana, in Cumayasa.

The 22 registered units identified in these areas encompass different types: a tourist apartment with a detailed inventory, a building with seven small apartments, a single-family home in a planned project, unbuilt land in coastal corridors, and rural properties in mountainous areas.

The ruling does not establish which specific convicted person corresponds to each of these properties, except in cases where the device expressly indicates it.

Samaná

  • The Samaná Province has six properties in the device, located in Las Terrenas and in the Sánchez Highway corridor towards Arroyo Barril.
  • Balcones del Atlántico, Las Terrenas
  • Apartment 13-1-B of the Balcones del Atlántico Condominium, registration number 1700007098, is located on 27 de Febrero Street in the Municipality of Las Terrenas, coordinates 19.325502, -69.513591. The document expressly categorizes it as a "tourist apartment" and dedicates two pages to its inventory of furniture, which is also subject to confiscation.

The inventory lists: a Haywar brand jacuzzi with a pump, four five-blade ceiling fans, a set of synthetic wood furniture with a glass coffee table, a marble dining table, LG televisions in two bedrooms, a kitchen with a complete professional Viking line of appliances, a refrigerator, stove, dishwasher, and stainless steel range hood. The linen closet contains four wines identified by brand and vintage: Puerta Vieja Crianza 2015, Herederos del Marqués de Riscal 2009, Baron Deley Finca Monasterio 2011, and Apothic Dark Red Blend 2014.

  • Five plots of land on the Sánchez-Samaná Highway, Arroyo Barril
  • The device identifies five parcels in the Arroyo Barril Municipal District, Santa Bárbara Municipality of Samaná, all along the Sánchez Highway corridor. None of them have a description of improvements in the fault:

The province of La Altagracia has four properties in the seizure, all in the municipality of Verón.

  • City of the Sun, house no. 8
  • Single-family dwelling type Bahía Victoria, sixth stage of the Ciudad del Sol project, registration 4000369223. Surface extension of 259.98 m² with 87 m² of construction area, coordinates 18.609490, -68.416650, Jinajaragua section, Verón.
  • Seven-apartment building, Beronsa neighborhood
  • Single-level property with seven apartments, registration number 3000315620, total area of ​​396.08 m², coordinates 18.605992, -68.439486. The device identifies them as apartments 1 to 7.
  • Two plots of land and an additional property
  • Registration 1000011213: 1,500 m², Jinajaragua section, Verón
  • Registration number 3000369175: 1,005 m², Almirante street corner of Caracoles, Villa Europa sector, Verón
  • Registration number 0100059132, plot SUB-147: 405.80 m², registered in the name of Félix Manuel Duran Calderón and Esmeralda Ortega Polanco de Duran

Jarabacoa and La Vega

The Jarabacoa area and the municipality of La Vega have seven properties included in the device.

Rancho Arroyo Naranjo

  • Two adjacent properties with titles 3000203632 and 3000203633, cadastral designations 313145076213, of 67.94 m², and 313145071296, of 2,372.97 m². A third title, 0300016756, records a transfer in February 2020.

Buena Vista Complex

  • Federico Basilis Road, Buena Vista Municipal District, Jarabacoa: property with two-level improvements in blocks and cement roof, registration 3000469423, 9,616.80 m², plus a plot of land of 1,500 m², registration 0300029398.
  • Other properties in Jarabacoa and Río Verde Abajo
  • Registration number 0300017786: 1,450 m², Jarabacoa Municipality
  • Registration number 0300017789: 1,450 m², Municipality of Jarabacoa, coordinates 19.215816, -70.586301
  • Country house, Río Verde Abajo: 1,828.87 m², plot 30 DC 15, with planting of chili peppers, corn, lemon and banana, coordinates 19.308741, -70.518969

La Romana / Cumayasa

  • Two plots in the Mar Azul Project, plot 7 of Cadastral District 01, Cumayasa location:
  • Lot 02, Block 39: 3,553.84 m²
  • Lot 04, Block 39: 3,553.80 m²

The device does not describe improvements in either of the two solar panels.

What the device does not establish

The ruling does not indicate whether any of these properties were rented at the time of the seizure, whether they operated as tourist accommodations on digital platforms or under contract with operators, or whether they generated declared income. It also does not specify the purchase price, the date of purchase, or the financing method for any of them.

What it does establish, as the basis for the confiscation, is that the court considered it proven that these assets are the product or instrument of the crimes judged in the case.

The sentence is not final. The convicted parties have the right to appeal, and the confiscation will not be carried out until the ruling is final. The full reading of the sentence, with its complete reasoning, is scheduled for August 14, 2026.

The convicted

The court convicted twenty individuals and found six legal entities guilty. The harshest sentences, twenty years of imprisonment, were handed down to Adán Benoni Cáceres Silvestre, Juan Carlos Torres Robiou, and Rafael Núñez de Aza, all three for criminal conspiracy, abuse of power, embezzlement, fraud against the state, illicit enrichment, and aggravated money laundering.

Julio Camilo de los Santos Viola and Rossy Maybelline Guzmán Sánchez received fifteen-year sentences. Eight other convicts received ten-year sentences, and four more received five-year sentences. In two cases, those of Manuel de Jesús Alba Solano and Élida María Trinidad Santiago, the execution of the sentence was suspended; Raúl Alejandro Girón Jiménez, under house arrest since May 5, 2021, accumulated enough time for the court to declare his sentence served.

The six convicted companies, CSNA Universo Empresarial, Randa Internacional Company, Aldom Glass Aluminium, Hacienda Kelman, R&F Agroindustrial and Rawel Importadores, were sentenced to definitive closure and dissolution.

The court was composed of Judge Esmirna Gisselle Méndez Álvarez, presiding judge; Judge Tania H. Yunes Sánchez, acting presiding judge; and Judge Jissel Y. Naranjo Tejada, member judge, assisted by Clerk Pamela Corcino Polanco. The full reading of the judgment, which will include the complete reasoning behind the ruling, was scheduled for August 14, 2026, at 3:00 p.m. in the same courtroom of the Ciudad Nueva Courthouse.
