The process includes 19 requirements, costs RD$1,000 for each resulting plot, and establishes a response period of 45 business days
SANTO DOMINGO. – The National Directorate of Cadastral Surveys of the Real Estate Registry establishes a series of conditions and technical steps to materialize the sanitation judgments issued in accordance with Law No. 1542-47, related to the adjudication of properties in the Dominican Republic.
This service is intended for individuals or legal entities that have a court-ordered land title issued by the Court of Original Jurisdiction (TJO) or the Superior Land Court (TST). To manage the process, interested parties must engage professionals qualified and authorized by the corresponding Regional Directorate of Cadastral Surveys.
Likewise, the entity offers two alternatives to submit the file: go in person to the reception of the competent Regional Directorate according to the location of the property or use the Virtual Office of Cadastral Surveys.
Documentation required to perform the procedure
To begin the process, applicants must gather legal and technical documents that allow them to verify the awarding of the property and confirm the results of the surveying work.
- Among the requirements established by the institution are: application for authorization, corresponding authorization, copies of the identity documents of the parties involved and a copy of the commercial registry, when applicable.
- Additionally, the document proving representation, if applicable, must be submitted along with a certified copy of the court order granting the property title. The date of the fieldwork must also be notified to the adjoining landowners and communicated to the Regional Surveying Directorate.
- Where applicable, interested parties must submit a notification to the Ministry of Environment and Natural Resources and present the certificate of no objection from that institution. These documents are supplemented by the survey and milestone record and the applicant's letter of conformity with the work presented.
- Finally, the file must include the technical survey report, the general and individual plans, photographs of the property boundaries, the file with the coordinates of the plot, the raw data of the survey and the proof of payment of the service fees.
Thus, the file must contain both the evidence of the judicial decision and the technical elements that support the work carried out on the ground.
Where can the documentation be deposited?
Once the requirements have been gathered, those interested have two channels available to submit the file to the National Directorate of Cadastral Surveys.
The first alternative is to go to the reception of the Regional Directorate of Cadastral Surveys that has jurisdiction over the territory where the property is located.
On the other hand, those who prefer to carry out the process remotely can use the Virtual Office of Cadastral Surveys, a platform enabled to send documents electronically.
Rate and response time
Regarding the cost, the service requires payment of the corresponding Property Registry fees, set at RD$1,000 for each resulting parcel. Furthermore, proof of this transaction must be included in the file.
For its part, the established deadline to receive a response is 45 business days, in accordance with article 52 of Resolution No. 789-2022.
During that period, the competent Regional Directorate of Cadastral Surveys has the responsibility to receive and process applications related to the technical execution of judicial decisions.
Who can manage this service?
The processing is the responsibility of professionals qualified for these purposes and authorized by the competent Regional Directorate of Cadastral Surveys.
These must act at the request of a natural or legal person who possesses an adjudication judgment issued by the Court of Original Jurisdiction or the corresponding Superior Land Court.
In that sense, having the court ruling is an indispensable condition to begin the process, in addition to complying with the documentary and technical requirements set by the authorities.
