SANTO DOMINGO.- The Superintendency of Banks (SB) has ordered the implementation of the Charter of Rights and Duties of Users of Fiduciary Services, a document that must be available in the financial intermediation entities (EIF) that offer fiduciary services and in the fiduciary companies supervised by this institution.
The provision is contained in Circular SB: CSB-REG-2026000020, which establishes the obligation to make available to users, beneficiaries, project representatives and related third parties clear information on the prerogatives and responsibilities that accompany the contracting of fiduciary services.
The initiative is part of the SB's efforts to strengthen the protection of users of fiduciary services and promote a greater understanding of these services, in line with the constitutional right of consumers to receive objective, truthful and timely information about the products and services they use.
A preliminary step in this direction was the inclusion of the fiduciary sector within the scope of the new Regulation for the Protection of Users of Financial Products and Services. This contributes to the development of best practices in the Dominican fiduciary market.
The Charter of Rights and Duties must be available before, during, and after the signing of trust agreements, both on websites and in physical offices and virtual channels of the supervised entities. Likewise, the entities must ensure that users receive this document and maintain evidence of its delivery and acceptance.
The circular also instructs entities to coordinate with the parties of real estate trusts the disclosure of the letter among third parties linked to the projects, and provides that the information may be disseminated through digital tools such as QR codes and other technological resources.
The SB highlighted that the measure responds to the need to strengthen fiduciary education and promote a better understanding of the rights, obligations and risks associated with the use of these legal entities, which are increasingly used for structuring real estate, asset and investment projects.
Entities have a period of 30 calendar days to adapt their digital channels and 90 calendar days to incorporate the letter into physical and digital contracts related to fiduciary services.
