Why did the DGCP suspend the registration of 11 senators as state suppliers?

SANTO DOMINGO.-The General Directorate of Public Procurement (DGCP) explained this Wednesday that the suspension of the State supplier registry of eleven senators on June 19 was carried out within the framework of the implementation of Law 47-25, which came into effect in January of this year, and which establishes a regime of absolute disqualifications for elected and appointed officials.

The governing body argued that, contrary to the repealed Law No. 340-06, which allowed the shareholding of 10% of first and second level officials, such as legislators, the new legal framework in force establishes in its article 38 the express prohibition of their corporate participation regardless of the percentage and prevents them from holding management, executive or board participation functions.

Through a press release, the DGCP recalled that, in the exercise of its powers as administrator of the Registry of State Suppliers, on February 13 of this year, it issued circular no. DGCP44-PNP-2026-001, granting a period of fifteen (15) business days to the officials and employees of the Dominican State included within the causes of disqualification in order to request the suspension of their RPE since after said period it would proceed with the suspension ex officio, in accordance with the provisions of article 69 of the Application Regulation no. 52-26.

The institution reiterated that the data cross-checks and the verification and due diligence tasks that resulted in the provisions of administrative act no. DGCP44-2026-002421 are part of its routine work to preserve the integrity of the RPE.

In that regard, he clarified that these provisions are not punitive in nature nor do they constitute a punitive measure against the holders of the State Supplier Registry (RPE), but rather they are a preventive and administrative measure whose purpose is to ensure strict compliance with the provisions established in Law No. 47-25 on Public Procurement, which establishes the disqualifications applicable to certain persons to contract with the State while they are in the exercise of functions.

81 RPEs suspended under the new law and 591

The DGCP revealed that, so far this year, since the entry into force of Law 47-25, 3 administrative acts have been issued (DGCP44-2026-000893; DGCP44-2026-001477 and DGCP 44-2026-002424), available on its website: https://www.dgcp.gob.do/sobre-nosotros/marco-legal/actos-administrativos/ that provide for the suspension ex officio of 81 RPE of elected and appointed officials.

Meanwhile, in the period 2020-2025 the governing body issued an administrative act and three resolutions that ordered the suspension ex officio of the RPE of 591 first and second level hierarchical officials, as well as municipal authorities elected in the period 2024-2028 and related commercial companies, in accordance with the provisions of article 14 of the repealed Law No. 340-06.
