Law 158-01: The guide on CONFOTUR in the Dominican Republic that investors should consult

SANTO DOMINGO.Law 158-01 on the Promotion of Tourism Development, known as the CONFOTUR Law, represents one of the greatest incentives that the Dominican Republic currently has to attract foreign investment in the area of ​​tourism.

1) Introduction

Law No. 158-01 on the Promotion of Tourism Development, known as the CONFOTUR Law, establishes the legal framework that regulates tax incentives for tourism and real estate projects in the Dominican Republic. This legislation defines the requirements, approval processes, and benefits applicable to developers and investors in areas prioritized for tourism development.

This legislation has been amended several times since its enactment in 2001, through laws No. 184-02, 318-04 and 195-13, with the aim of expanding its scope and adapting to the new dynamics of the Dominican market.

Below is an expanded and detailed guide to understanding how this law works, what benefits it offers, and what its real implications are for investors, developers, and buyers.

1) Objective of the law

The regulations aim to promote the development of tourist hubs outside of traditional destinations, encourage economic decentralization, attract foreign direct investment, generate employment and boost local economies, as well as promote sustainable and ecotourism projects.

In that context, a significant portion of the approved projects are concentrated in areas such as Punta Cana, Samaná, Miches, Puerto Plata and Pedernales, known as the nation's main tourist destinations, which are currently expanding.

2) CONFOTUR's step-by-step process

Access to benefits is not automatic. The process involves several technical and legal steps.

2.1) Application for provisional classification


The developer submits a file to the Ministry of Tourism of the Dominican Republic, through the CONFOTUR office, which must contain the following information:

  • Company legal information
  • Feasibility studies
  • Architectural plans
  • Investment budget and environmental assessment

2.2) Project evaluation


The Council analyzes criteria such as:

  • Financial viability
  • Economic impact
  • Strategic location
  • Alienation from tourism policies.

2.3) Provisional approval and classification


If the project is approved: construction can begin and access certain initial incentives.

  1. Final classification
    Once built and ready to operate: a final inspection is carried out and full benefits are granted.

3) Tax benefits

The regime includes incentives for both developers and purchasers of properties within approved projects.


For developers, it includes:

  • Income Tax Exemption
  • The exemption from import taxes on equipment, furniture and materials
  • Exemption from municipal taxes
  • The exemption from ITBIS on goods and services related to construction.

In the case of buyers, the exemption from the real estate transfer tax, equivalent to 3%, called Real Estate Property (IPI), is contemplated, and in certain cases, tax benefits on the profits linked to the project.

The duration of these incentives can be extended up to 15 years, depending on the type of project and the conditions of its approval.

4) Types of projects that qualify

CONFOTUR encompasses a wide variety of tourism developments:

  • Hotels
  • Resorts
  • Condo-hotels
  • Tourist villas
  • Tourist real estate projects
  • Theme parks
  • Marinas and yacht harbors
  • Complementary infrastructure (restaurants, tourist shopping centers)
  • Eco-tourism and sustainable projects.

It also allows for mixed developments, which has boosted the rise of residential communities with a tourist focus.

Originally, it applied only to underdeveloped areas. However, with its modifications, it can now encompass: traditional tourist destinations (under certain conditions), new priority areas defined by the State, and tourism renovation or redevelopment projects. This has allowed even established destinations to continue attracting investment under this system.

5) Duration of the process

The evaluation process can take between three and six months, although in some cases it may be extended if the application requires further review, corrections, or evaluation by the institutions involved. Since it includes a technical, legal, and economic review of the project, it is crucial to submit everything correctly from the outset to avoid delays.

6) Main requirements

The process requires rigorous technical and legal compliance. Among the main requirements:


• Legal incorporation of the development company
• Land title
• Approved environmental impact study
• Detailed investment plan
• Compliance with urban planning and tourism regulations
• Registration with tax authorities (DGII)

In addition, the project must demonstrate its sustainability and contribution to national tourism development.


Obligations and conditions:


• Begin operations within the established timeframe
• Comply with tourism quality standards
• Maintain the use of the project in accordance with its approval
• Report information to the Dominican authorities

It should be noted that non-compliance may result in the loss of tax benefits.

7) Huge impact on the real estate market

The reasons:

  1. Higher profitability: tax reduction improves return on investment (ROI).
  2. Increased foreign demand: international investors see the country as a fiscally attractive destination.
  3. Development of new areas: previously little-exploited areas now have modern tourist infrastructure.
  4. Economic revitalization: generation of direct and indirect jobs in construction, hospitality and services.

Various advantages

The main advantages of the regime include tax savings, legal certainty, and incentives for long-term investment. However, access depends on project approval, benefits may be limited to certain purchasers, and the evaluation processes can be lengthy.

Before making an investment in projects under this regime, it is recommended to verify the final classification of the project, confirm the validity of the tax incentives, review the developer's history, evaluate the location, and have specialized legal and real estate advice.

The CONFOTUR Law has become a cornerstone of tourism and real estate growth in the Dominican Republic. Its combination of tax incentives, institutional support, and strategic focus positions it as a key tool for both local and foreign investors.
