The Executive Branch approves, by decree, the Implementing Regulations of the Law on Territorial Planning

Among the contributions offered by this regulation, the obligation of local governments to design and approve territorial planning plans stands out, which will allow for more efficient management of land use in municipal districts.

SANTO DOMINGO.President Luis Abinader issued Decree No. 396-25, which approved the Regulations for the Application of Law No. 368-22 on Territorial Planning, Land Use and Human Settlements.

Among the significant contributions offered by this regulation, the obligation of local governments to design and approve territorial planning plans stands out, which will allow for more efficient management of land use in municipal districts.

"This obliges municipal urban planning offices to grant authorization to develop infrastructure projects compatible with the nature of the soil types in each municipality," a press release from the Presidency highlights.

Likewise, in areas intended for the development of tourism projects, approval will be required for both the land use permit from the local governmentand the certification of no objection from the Ministry of Tourism for the viability of the project in question.

Likewise, the regulations establish that the Ministry of Finance and Economy will be the competent authority to certify which municipal districts comply with the requirements of paragraph I of article 24 of the aforementioned Law No. 368-22, for the management of land use in their respective territorial demarcation. 

This regulation, whose draft was prepared by the Vice Ministry of Territorial Planning and Regional Development of the Ministry of Economy and duly submitted for public review, was also socialized and discussed in a process led by the Legal Counsel of the Executive Branch

This involved important government institutions, such as the Ministries of the Presidency, Tourism, Housing, Habitat and Buildings; representatives of associations linked to municipal issues, as well as sectors of the business field that would be impacted by this regulation.

These initiatives aim, through strategic planning and participatory land use management, to promote the comprehensive and balanced development of municipalities in accordance with the potential, expectations and aspirations of their respective populations, so as to guarantee them the necessary conditions to improve their quality of life.
