SANTO DOMINGO.- The Plenary of the Supreme Court of Justice (SCJ) put into public consultation the proposal to modify resolution 790-2022 on the Regulation for Parcel Regularization and Demarcation, with which it intends to shorten deadlines and simplify procedures in processes without property conflicts.
According to information published on the Real Estate Registry website, the Dominican high court will review three key articles of the regulations to expedite land titling, while maintaining demarcation as a judicial route in cases of litigation.
In this call, open from August 19 to Monday, September 29 of this year, citizens, lawyers, related professionals and interested entities may participate, who must submit their observations and comments on the proposal by email.
The Secretary General of the Supreme Court of Justice, César García Lucas, stated that the initiative is based on the Constitution of the Dominican Republic and on Law 108-05 on Real Estate Registry, which empowers this body to issue the regulations and complementary rules required for the application and development of the provisions of said law.
“The proposed regulation preserves the demarcation as a contradictory figure (the right of a defendant to oppose or contradict what the plaintiff claims in their lawsuit) and as an exception (a legal tool used by the defendant to stop, modify, or annul the plaintiff's legal action) for cases with litigious characteristics that require the intervention of the courts,” César reported.
He also detailed that the proposed modifications cover articles 5, 8 and 9 of the current regulations, redefining the essential conditions of parcel regularization and consolidating the aspects that must be verified by the Regional Directorates of Cadastral Surveys and the Title Registries when exercising their qualifying functions.
