Three essential aspects that the new RI provision will bring, according to a lawyer

SANTO DOMINGO. – Lawyer and real estate law specialist Massiel Martínez described the recent Technical Provision DNRT-DT-2025-001, issued by the National Directorate of Title Registration (DNRT), regarding preventive annotations, provisional registrations, and informative annotations, as a significant and positive step forward for the legal security of the real estate market.

Martínez explained to El Inmobiliario that, until now, the use of these figures had generated "operational insecurity" in some processes, by prolonging entries without a clear registry definition or using them as a substitute for a definitive registration.

“With this regulation, the DNRT establishes uniform criteria and specific deadlines that will avoid unnecessary blockages in the Title Registries, provide greater predictability to lawyers, developers and buyers and, most importantly, strengthen certainty about the legal status of properties.”

The expert pointed out that the legal and real estate sectors a comprehensive review of the registration system for years

Since the enactment of Law 108-05 on Real Estate Registration, he explained, there was a need to update the technical guidelines in accordance with the reality of the current market , "which is more dynamic and digitized and demands clear and transparent processes."

According to Martínez, the provision guarantees three essential pillars of the registration system:

  • Define the effects of each type of annotation (preventive, provisional and informative), avoiding arbitrary interpretations.
  • It establishes clear deadlines and legal consequences, reducing the risk of "perpetual entries".
  • It strengthens legal certainty through the reliability of the Title Registry as an instrument of certainty and protection of rights.

In practical terms, the lawyer highlighted that this provision brings order, uniformity, and confidence to the real estate and legal system by improving registration efficiency , facilitating decision-making for investors and developers, strengthening the role of the Registry of Titles as a guarantor of property rights, and promoting a culture of professional responsibility among legal professionals.

“Technical Provision DNRT-DT-2025-001 not only modernizes the Dominican registry system, but also sends a clear message: legal certainty is the foundation of a reliable, transparent, and competitive real estate market,” Martínez concluded.
