SANTO DOMINGO. – The fourth liquidation chamber of the Superior Administrative Court revoked resolution 007/2020 that ordered the construction of the Bávaro International Airport, after hearing the appeal filed by the Eastern Airport Corporation SAS against the Ministry of Public Works and Communications (MOPC).
The court specified that one of the essential points of the request is that the public institution "violated due administrative process", as well as "the guiding principles" that govern the exercise of state administration.
Therefore, after studying the arguments presented by the parties and verifying the evidence submitted, the court indicated that the Airport Commission should have notified the defense document presented by Grupo Abrisa and Aeropuerto Internacional de Bávaro, SAS , companies responsible for the promotion and total investment of the project.
The ruling also states that the Airport Commission should have complied with an administrative process that guaranteed the right of participation of the Eastern Airport Corporation SAS, and that by not doing so it "violated its right to defense".
“Given the circumstances of the case, as well as the facts previously verified by this Fourth Chamber, Resolution No. 007/2020 dated June 12, 2020, issued by the MINISTRY OF PUBLIC WORKS AND COMMUNICATIONS (MOPC), is hereby revoked, as it subverts the constitutional order by failing to comply with due process, and therefore the appeal is accepted,” the ruling reads.
