Amended SCJ regulations promote access to titled real estate property

SANTO DOMINGO. -The Plenary of the Supreme Court of Justice (SCJ) approved the modification of the regulations for land regularization and demarcation, with the objective of expanding the scope of its application.

The new regulations establish parcel regulation as the general rule for individualizing a portion of land, and reserve demarcation as an exception for the judicial stage, only when a contradictory process is necessary.

The proposed amendment to regulation no. 790-2022 was submitted to a public consultation process, which took place from August 19, 2025 until Monday, September 29, 2025. It was approved in a plenary session held on October 9.

Advantages

Among the advantages of the regulatory modification are the promotion of access to titled real estate, duly individualized and located, through the simplification of the conditions and requirements for parcel regularization ; reserving the demarcation process as a contradictory and exceptional figure, applicable only in cases with litigious characteristics that warrant judicial intervention.

The use of land regularization is also , strengthening the social and legal cohesion of the real estate system. 

Among the new features is also the addition of a paragraph to Article 6 of Resolution No. 790-2022, which establishes that the annotation made in the Complementary Registry of the property, which certifies that it is being subject to a parcel regularization process, will be valid for one year from the date of its registration. 

This entry may be cancelled with the approval or rejection of the technical work issued by the competent Regional Directorate of Cadastral Surveys, or upon expiration of the validity period.

The plenary session was composed of presiding judge Henry Molina, and magistrates Manuel Ramón Herrera Carbuccia, Francisco Antonio Jerez Mena, Manuel Alexis Read Ortiz, Fran Euclides Soto Sánchez, Nancy Idelsa Salcedo Fernández, Justiniano Montero Montero, Anselmo Alejandro Bello Ferreras, Rafael Vásquez Goico, Vanessa Elizabeth Acosta Peralta, María Garabito Ramírez, Moisés Alfredo Ferrer Landrón and Francisco Antonio Ortega Polanco.
