What is the legal status of a property?

The legal status of the property is the document where you can identify if the property has any mortgages or encumbrances. (External source).

When buying or selling a property, it's essential to ensure everything is in legal order, as this guarantees your investment. For real estate agents, issuing a document called the property's legal status certificate is mandatory at the time of closing. Here's what it's all about.

When buying or selling a property, it's essential to ensure everything is in legal order, as this guarantees your investment. For real estate agents, issuing a document called the property's legal status certificate is mandatory at the time of closing. Here's what it's all about.

The certificate of legal status of a property (encumbrances and liens), as it was previously called, is the document that allows you to identify if a property has mortgages or encumbrances. The entity authorized to issue it is the Real Estate Jurisdiction.

The requirements to obtain it, as established by the Real Estate Jurisdiction on its website, are:

Application submitted by the interested party to the corresponding Registry of Titles; complete details of the applicant, their address and telephone number. Specification of the surface area, if there is more than one. Description of the property with cadastral designation (parcel, building lot, block, DC, registration number) and name of the owner.

Attached Documents:

Duplicate of the title certificate or annotated record, copy of the depositor's identity document (both sides)

-You must pay at the Banco de Reservas in your district the sum of RD$1,000.00 (code 004 of the service fee form), in addition to two taxes at the General Directorate of Internal Taxes (DGII ) (one Law 91 stamp RD$50.00 and one

 Receipt Law 33-91 RD$10.00.).

Note: Fees for remote filings with the various title registries are payable at Banco de Reservas. The remote filing fee for the province of Santo Domingo is RD$300.00 (code 015 on the service fee form). The remote filing fee for other locations in the interior of the country is RD$800.00 (code 016 on the service fee form).

 

Observations: 

The Cadastral District determines which title registry your property belongs to. For properties in the National District and Santo Domingo Province, Cadastral Districts 02, 03, 04, 05, and 13 belong to the National District. Cadastral District 01 is shared between the Santo Domingo Province Title Registry and the National District Title Registry. All other Cadastral Districts belong to the Santo Domingo Province Title Registry.
