What should a contract contain according to the draft rental law?

SANTO DOMINGO - The draft law on real estate rentals and evictions , approved last week in the Chamber of Deputies, details in Chapter III the minimum elements that every rental contract in the Dominican Republic must contain, if the proposal is approved, which must be reviewed again in the Lower House and subsequently in the Senate.

The initiative highlights the aspects that, according to article 5, every rental agreement must contain:

1) General information of the parties or their duly authorized legal representatives;

2) Exact address and details of the property subject to the contract;

3) Detailed description of the property and its facilities, services, accessories and unbuilt spaces incorporated into the rental and the state of conservation of the assets;

4) Individualized description of the furniture, if any, that the parties agree to include in the contract, with its characteristics, numbering, state of conservation and any other sign useful to identify them;

5) Express mention of the specific purpose or use to which the rented property will be dedicated;

6) Amount of the rental price, as well as the date, place and method of payment;

7) Lease termination date;

8) Address of choice that the parties indicate for notifications; 9) Date of the contract.

Likewise, paragraphs one and two establish additional requirements that the contract must contain:

"The owner or landlord reserves the right to require the tenant or lessee to provide proof of a joint and several guarantor, who, in the absence of the tenant or lessee, assumes all the obligations of the contract towards the owner or lessor," says paragraph I.

Paragraph II.- In case of tacit renewal, the obligations of the joint guarantor are extended until the delivery of the property to the owner, unless the latter has communicated the termination of the contract within the agreed time.
