The Real Estate Registry issues technical provisions on the receipt of documents and digital actions

The new rules establish uniform requirements, processing times and recognize the full validity of electronic procedures under qualified digital signature.

SANTO DOMINGO – The Property Registry announced the Technical Provision on Receipt and Delivery to the Title Registry and the Technical Provision on Requirements for Registry Procedures, both aimed at standardizing criteria and streamlining processes at the Title Registry offices. These measures are part of a regulatory update seeking greater efficiency in the management of documents and applications.

The first provision regulates the procedures for receiving and delivering documents, establishing deadlines, requirements, and formalities that both users and registry offices must comply with. This aims to ensure a more organized and transparent handling of applications, preventing delays and guaranteeing traceability at each stage of the process.

The second provision also establishes the requirements for registry procedures, defining which documents are essential for each type of application and how they must be submitted. The aim is to eliminate duplication, simplify processes, and ensure that all offices apply uniform criteria when reviewing files.

Both provisions also introduce the possibility of carrying out procedures electronically, reinforcing the transition to a digital registry system. This includes the validity of documents signed with a qualified digital signature and interoperability with other public and private institutions.

Article 17. Digital Registry Procedures

Applications, registrations, entries and other registration procedures may be carried out entirely by electronic means, using platforms enabled by the National Directorate of Title Registration.

Full legal validity is recognized for electronic documents signed by qualified digital signature, in accordance with the Digital Media Law and Law No. 108-05 on Real Estate Registration.

The physical appearance of the applicant or their legal representatives will not be required, except in cases expressly provided for by the regulations.

The processing times for digital actions may not exceed seven (7) business days, counted from the electronic receipt of the request.

The Title Registry will guarantee interoperability with other public and private institutions, as well as the preservation and security of electronic documents.

Actions carried out in accordance with this article will have the same effectiveness and probative force as those carried out in person.

These regulations aim to standardize criteria across all Title Registry offices, reduce processing times, and ensure that files are handled according to defined procedures. Taken together, they represent a regulatory adjustment that streamlines internal operations and facilitates the implementation of more efficient and verifiable processes.
