New clash over the Canal: Chinese operator CK Hutchison announces legal battle against Panama

The dispute over control of the ports linked to the Panama Canal has entered a new chapter. Panama Ports Company (PPC) , a subsidiary of the Hong Kong-based conglomerate CK Hutchison Holdings , announced that it will appeal the Panamanian court's decision to revoke its concession to operate two strategic terminals, while accusing the country of causing significant economic damage and acting on political motives.

The conflict arose after the Supreme Court declared unconstitutional the contract that allowed the company to manage the ports of Balboa, on the Pacific coast, and Cristóbal, on the Atlantic coast —key facilities for global maritime traffic. The company has initiated international arbitration proceedings to challenge the ruling, a move that opens a legal phase with implications beyond the local sphere.

The court held that the concession violated the Constitution and did not serve the public interest, a conclusion that was also supported by audit findings that pointed to irregularities in the 25-year contract extension granted in 2021.

A strategic point for world trade

The controversy is further amplified by the location of the terminals. The ports operated by PPC are situated at both ends of the Panama Canal, an infrastructure considered critical for international trade and for the logistics chains connecting Asia, the Americas, and Europe.

The ruling has been interpreted as a blow to Chinese business presence on a strategic route, amid growing rivalry between the United States and China over influence over key infrastructure in Latin America. The United States had cited the operation of the ports as a matter of national security, while China condemned the decision and called for respect for the contracts.

It was even reported that Beijing had ordered the suspension of negotiations for new projects in Panama as part of a broader response, which could affect future investments worth billions of dollars.

Global rivalry and political pressure

The scenario reflects an intensifying geopolitical competition. Analysts point out that the cancellation of the contract coincides with the US strategy of limiting Chinese influence in strategic infrastructure in the region, while companies and governments watch as the Canal once again takes center stage on the international stage.

The annulled concession dated back to the 1990s and allowed CK Hutchison's subsidiary to develop, manage and operate port terminals in the canal environment, which explains the economic weight of the case and the business reaction to the ruling.

The Panamanian government, for its part, has assured that port operations will continue without interruption during the transition to a new management scheme, with the aim of preserving the continuity of maritime trade.

The court ruling also threatens a $23 billion linked to the sale of CK Hutchison's global port assets, adding financial pressure to the process and increasing interest from international investors.

Meanwhile, the company's threat of legal action and China's open criticism demonstrate that the case is no longer limited to a contractual dispute. The Panama Canal—one of the most influential maritime routes on the planet—is once again the scene of a dispute where trade, investment, and geopolitical power converge.
