Former Environment Minister calls the ruling to modify the boundaries of Jaragua National Park "reckless"

The recent ruling by the Superior Administrative Court (TSA) ordering the modification of the boundaries of Jaragua National Park continues to generate reactions within the environmental and legal communities. Former Environment Minister Francisco Domínguez Brito expressed his rejection of the decision, considering it a serious risk to the protection of natural heritage and potentially setting a precedent for other protected areas in the country.

The ruling, which has already been appealed by the Dominican government, orders a review of the park's boundaries, a measure that has ignited debate about the legal security of territories under environmental protection. Jaragua is part of the National System of Protected Areas and is recognized for its ecological value, as it harbors coastal ecosystems, dry forests, and a wide range of biodiversity.

“A precedent that jeopardizes all protected areas”

Domínguez Brito stated that the decision has caused a stir due to its potential implications beyond the park itself. “We are shocked by this decision , not only because it affects Jaragua National Park, but also because of the precedent it sets,” he noted, warning that this type of ruling could reopen the door to past attempts at illegal land appropriation within protected areas.

The former official described the ruling as reckless and argued that, in his opinion, it violates the constitutional framework. He explained that the Constitution establishes that the only way to reduce a protected area is through the approval of two-thirds of Congress, and therefore—he indicated—it is not appropriate for decrees or judicial decisions to alter those boundaries.

Call for institutional alert

Domínguez Brito warned that the measure could weaken the integrity of the National System of Protected Areas and expose strategic ecosystems to economic and private pressures. In this context, he considered that the situation compels authorities to remain vigilant and act within their respective jurisdictions to prevent more far-reaching effects.

“This jeopardizes all other protected areas. It forces the authorities to issue a general alert,” the former minister stated, while urging the President of the Republic to speak out and activate state agencies to respond to the legal scenario opened by the ruling.
