The Environment Ministry determined that the project violated the use of public space

SANTO DOMINGO.- The Ministry of Environment ordered the cancellation of an environmental permit granted in 2017 for the construction of an apartment tower in Juan Dolio, San Pedro de Macorís, after determining non-compliance with the environmental regulations established for the construction of this type of project.
The institution ordered the revocation of the permit through resolution DJ-RA-2-2-2021-0019 , issued in October of this year, after a complaint was filed alleging that the “Le Parc Beach Front Juan Dolio” project did not comply with the environmental compliance reports established in the Environmental Management and Environmental Adaptation Program (PMAA).
The complaint also indicated that the area has been impacted by the development of the project, "since it was conditioned on not carrying out solid constructions, but lightweight materials" and that the construction "modifies the coastline, causing erosion and loss of the beach, polluting by altering the landscape and noise from bars, the filling of wetlands, destroying the ecosystem and promoting the decrease of the drainage of the area, violating the environmental permit.".
Last March, the Vice Ministry of Environmental Management conducted an inspection of the facility, which determined that "the perimeter fence of the project facing the coast is 27 meters from the high tide mark.".
The report details that “the building, constructed within 60 meters of the public domain, is made of concrete, while the permit allows for lightweight construction, disrupting the harmony of the landscape and increasing the environmental impact.” It adds that Presidential Decree 332-17 “authorizes a use of no more than 30 meters of the public domain.”.
The resolution revoking the permit states that the conclusions of the technicians involved in the inspection, cited by a commission of the Vice Ministry of Coastal Resources and the Environmental Directorate and Inspection, indicate that "the structure built in the 60-meter area of use, transgresses the rational sense of the use of the space and prevents access to the sea by occupying the lateral ends with those adjacent to the east and west.".
Environment details: “It is not incontrovertible that the information extracted from the inspections carried out by technicians from the Ministry of Environment and Natural Resources, determines that the construction notably violates both Environmental Permit No. 3167-17, its provisions, as well as what is provided by the presidential decree.”.
The Ministry adds that the Environmental Assessment Process Regulations stipulate that the suspension or cancellation of environmental authorizations will be carried out through an administrative resolution when violations of the PMAA, the conditions under which the permit was granted, or violations of current environmental regulations are verified. Le Parc Beach Front Juan Dolio was announced with an investment of $12 million. In September 2016, then-President Danilo Medina attended the groundbreaking ceremony accompanied by several officials from his administration, including former Minister of Tourism, Francisco Javier García.
The environmental resolution states that the project was a 21-story building with 121 one-bedroom apartments. It included a 360-degree panoramic terrace, beach club, walkways and paths/lounge bar, mini-market, restaurant, spa, solarium, gym, BBQ area, children's play area, meeting and party rooms, parking, swimming pool, security gate, and other amenities.
